I see that my comment, on not being able to comment, has been deleated also.
Just remember folks, EULAs are legally binding contracts, and once you accept it, Terminal Studio has the right to fulfill there side of the contract any time they want to. You are not accepting the new and improved EULA, when you downloaded and instaled this game yesterday, are you?
Good Day,
Barry

Kudos to GGotD for following up!

Occasionally mistakes happen. I'm glad to see that GGotD ensured that the EULA was a misprint. Hopefully this is a problem we have seen the last of :-)

I, for one, appreciate what this site is trying to do as far as opening a marketing channel for little-known/unknown software producers.

Although I personally haven't purchased any programs from any of these companies, I have lead a few people to a couple of the sites of the games I do enjoy (mostly Alawar).

Keep up the good work.

there is one obvious lesson to be learnt from this offering.
people will not accept software with (or which we assumed had)
such abusive conditions in their EULA.
any company (terminal studio) wishing to be succesfull better think twice before making such "dangerous dicisions" for their software.
if it was a false alarm or not, wherether the game was good or bad,
i think this is the more important lesson to be learnt from all this.

#37, the way some people act, I'm surprised that this much restraint was shown. An impatient and insultingly accusatory question was asked; an answer was received, and I did not find it to be particularly nasty. There are polite way to call someone's attention to an oversight. Anyway, based on reading through these comments day to day, it's just plain obvious that some of the folks who come here are complete chowderheads who can erode even the best customer service skills. Nobody needs those kind of customers, IMHO. I've been coming to these sites since True Launch Bar was given away; I've only seen a couple of apps since that truly interested me (it kills me that I missed Styrateg), but I don't get all snotty like other folks.

My earlier comment didn't get through, we'll see if this one does. Suffice to say it contained more details from that rotten EULA (for newbies, that's End Use License Agreement.) It's good to see GGOTD followed up on this one, but it's a rather large oversight on the part of Terminal Studio! Don't they know what they're selling and to what their potential customers might be agreeing? Where does Terminal Studio get their games if this one previously had spyware and adware?

There's a lesson here, never be so anxious to finish installation of ANY software without reading the EULA. Most people click past it, but you never know what you might find hidden inside. Personally I always read or at the very least give it a good visual skim, especially if it's much longer than usual like today's. Stopped the installation based on what was there and immediately ran full scans. Happy to report nothing was found, but I was still turned off by that EULA and never installed the game.

"May be because comments are premoderated by human beings? Sometimes we need to sleep, and we are not in PST timezone.
I’ll check the game and EULA."

Getting nasty with your customers when you're called to correct won't work either. How professional is that?

You were the ones that claimed your software would be clean. It is your responsibility to see to it that is true and we don't have to find out otherwise via the nasty bury it in EULA tactic.

Please check comment #32, I checked the software, it's ok, no adware.

Okay, good news and bad news.
Good one - there is no spyware or adware, no special folder in IE or something. Clean.
Bad one - there is an outdated EULA. I'll tell Terminal Studio guys about that.

Anyone wonder why there are so little comments on this game today? Notice there has not been a posting since 11:05 am. I made a post which was not allowed to be seen along with I am sure many others. Are you going to sensor this one too GOTD staff? Why don't you let the truth be told.

This software is being complained about because people do not like it's EULA. It's not good and you know it. You have children and others downloading this stuff that you know do not understand what the consequences of this action will be. This hide it in the EULA trick is an old and dirty one.

You assure people your products are malware/adware free and this shows they clearly are not.

Even if you do not allow my post to be seen this software is here on your site and attention is being called to it and the manner in which you are handling the EULA issue. The fact that you are censoring posts concerning this only makes it worse.

You've had a decent thing going. Why blow it? We all make mistakes. Admit it, correct the error and move on. Try to snow people and you will pay the price. The security community has a long and unforgiving memory.

May be because comments are premoderated by human beings? Sometimes we need to sleep, and we are not in PST timezone.
I'll check the game and EULA.

I am with Max (#14). I keep seeing this 'Race Cars: The Extreme rally' as Terminal Studios keeps providing games to GGOTD, but it is never offered as a free download. Then again, if the EULA is anything like the one in this game (thanks John #9 for the heads up!), I may not even install that one either. I thought GGOTD had higher standards.

I would love to try the game out, but like many others GOTD clearly states that the apps or games will be ad and spyware free. The EULA is scary, you might as well have a remote desktop connection to my pc! I love the free apps and games but if this continues I will stay away from this site. Thank you #9!

Further to #15 - I guess the wording does say "may include", so it's possible the version GGOTD has received has been cleaned up ... Plus it also mentions putting the folder into 'Internet Explorer'? Well I avoid using that old piece of poop like the plague anyway, so I guess it might not be a problem if one uses a better browser. But I'm not going to bother finding out on this occasion. So, 'til tomorrow...

#9 John - Thanks for the 'heads up regarding the cheeky marketing ploy included in this package. I probably wasn't going to bother with today's game anyway, but I definitely won't now.

I'm hoping that, since this wouldn't have been found by scanning for viruses, etc, our lovely GGOTD'ers just made a one time slip up and missed this tucked in behind the scenes. I, for one, wouldn't like this to become a regular addition ...

What part of the "100% Clean; No adware; No Spyware" am I nisunderstanding? The EULA of this program clearly spells out in plain English that it is both adware and spyware.

Thanks to the few people that downloaded and read the EULA before installing, I definitely won't be installing this one.

What's the deal, Lucille? Is GotD going to police themselves? It's been a great ride so far; I don't really want to get off. But...

IRT: #9 - John - WOW!! Nice catch!

G/GAotD Team - --LOVE-- what you're doing - BIG THANKS!! - but that EULA is a crime. It does your Netizens a dis-service.

I've just been skulking the last few weeks waiting for the other shoe to drop - seems I've seen one. Tactics like these will chase your surfers away in droves. Please take steps to protect them and yourselves!

Your site and downloads claim to be "100% CLEAN - No Adware! - No Spyware!" Stick to your guns and point them at the software providers!!

Read the EULA people. Here's what's in it:

-Upon installation we may add a pre-designed folder inside your favorites menu in Internet Explorer. On a daily basis, AT-Games.com will look for new special offers that may be inserted into your folder.
-Contextual Marketing Windows may also appear as windows on top of or underneath other windows on your computer desktop.
-Special offers may also be presented to you in the form of desktop icons and installation files.
-When you download the initial installation of AT-Games.com it may come bundled with additional partners.
-If a newer version is available, it will be downloaded and installed automatically. AT-Games.com also works with third parties. At times, AT-Games.com may include such software in one of it's updates.
-The AT-Games.com software collects and maintains information on both current and historical browsing.

And that's not the entire EULA, I quit after this far. Sorry, not going to install this one.

Thanks, John, I'll let guys at Terminal know, although that's just an outdated EULA, no adware is there, I checked it.

Perhaps I have been spoiled by the graphics on Bejeweled II, but the Diamond Puzzle graphics are not the brilliant, dazzling colors for which I hoped. The screen seems very one-dimensional (flat); the colors seem dull and washed-out. The jewels themselves are not as animated as those on other jeweled games.

On the bright side, the game installs easily and should work beautifully on older computers or those with smaller video cards.

Decent game, but I will not be keeping this one. Sorry, Giveaway Team.

I regretted installing Diamond Puzzle. It scrambled my screen and hung up the system after I'd try to go for the full screen option. I had to do a hard reset. And, yes, I do have all the latest drivers including the one for the display. A great pity - my first bad experience of a giveawayoftheday program.
